You must be legally able to enter a binding contract in your jurisdiction to use the Service. The Service provides AI-assisted software generation, hosting-related features, and related tools as described on our website and documentation.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate registration information and keep it current.

If you sign in with Google or another OAuth provider, you authorize us to receive and use the profile information permitted by that provider to operate your account. You remain responsible for compliance with the provider’s terms and for securing your identity provider account.

You agree not to misuse the Service—including attempting unauthorized access, interfering with other users, distributing malware, scraping in violation of our policies, or using the Service to violate applicable laws or third-party rights. We may suspend or terminate accounts that violate these Terms.

Platform IP: The Service, including its software, branding, user interface, documentation, and underlying technology, is owned by GOBY LLC or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

Your content: You retain ownership of text, prompts, and materials you submit (“User Content”). You grant GOBY a worldwide, non-exclusive license to host, process, transmit, and display User Content solely to provide and improve the Service.

Generated outputs: Subject to your compliance with these Terms and applicable law, GOBY grants you a license to use outputs generated for your projects in accordance with your plan and our documentation. You are responsible for ensuring your use of outputs complies with law and does not infringe third-party rights. Certain marketplace, escrow, or transfer terms may apply to specific transactions and are governed by additional terms presented at the time of purchase.

The Service may integrate with third parties (e.g., payment processors, hosting providers, OAuth identity providers). Your use of those services may be subject to their terms. We are not responsible for third-party services beyond our reasonable control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

To the maximum extent permitted by law, GOBY LLC and its affiliates, officers, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our aggregate liability for claims arising out of or relating to the Service shall not exceed the greater of (a) the amounts you paid to GOBY for the Service in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100), except where prohibited by law.

You agree to indemnify and hold harmless GOBY LLC and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

We may suspend or terminate access to the Service for violation of these Terms, risk of harm, or as required by law. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for disputes subject to this clause, where permitted by law.

We may modify these Terms by posting an updated version on this page. Continued use after the effective date may constitute acceptance. If you do not agree, you must stop using the Service.
